As a break from my recent juvenile rants about other lawyers’ cluelessness, I am going to address a more serious legal issue; the significance of Casey Anthony’s check fraud case in relation to her First Degree Murder case.

This will be the first of a two part series and this first post will discuss why the State would want to try the Check Fraud case before the First Degree Murder case. The second post will discuss how the defense will likely try to avoid trying the Check Fraud case first.

As a refresher, in her Check Fraud case, Casey Anthony is charged with thirteen separate felonies that also happen to be crimes of dishonesty. Now in relation to the Murder case, the Check Fraud case would seem insignificant.

However, it is the 13 separate convictions that the Check Fraud case provides which is the true strategic prize for use in the Murder case. But why?

Although you make a good point, I'd question who is being paid for this- by advertisements or publicity. In other words, I could start a blog and write whatever I wanted about Caylee and the money from ads would go straight to my wallet. IMO- that's wrong.

Looking ahead to the Casey Anthony capital murder trial, Orlando criminal lawyer and legal analyst Richard Hornsby reckons the legal process will be a "cash cow" that could be lucrative to future jurors, because "anything related to this case can have a lasting value."

Previously, in part 1 of True Crime Examiner's exclusive interview with Hornsby, the likelihood of Anthony agreeing to a plea bargain is possible, if the accused murderer, Hornsby says--who is tired of her celebrity and has had time to reflect--warms to the advice of attorney, Andrea Lyon.

Hornsby says the DePaul University clinical professor of law and Anthony team's unofficial new captain "wouldn't be doing her job" if the death penalty expert did not present the opportunity for possibly saving her client's life.

In part 2 today, Hornsby sheds light on the yet-determined Anthony panel, exploring jury behavior the legal analyst views as a component before, during and after the trial.

So it is not just media/entertainment likely to Cash in on the case (Caylee's Death) but all manner of people involved. The actual lawyers (Bozo et al), but also Jurors, prosecutors and all manner of people.

Anthony’s lawyers filed the motions saying there isn't enough information in the murder indictment for Anthony to defend herself so they want it thrown out. They are also trying to get the check fraud case dropped too claiming double jeopardy because she faces several counts of basically the same charge.

My predictions- State takes all, Defense wins nothing.

ORLANDO, Fla. Defense attorneys for Casey Anthony have filed a motion requesting that the court declare her indigent and have the taxpayers shoulder some of the cost of her defense.

Jose Baez filed the paperwork at 5 p.m. Friday. He is asking Judge Stan Strickland to declare Anthony indigent for costs, meaning she does not have the money to fund her defense.

Anthony is charged with first-degree murder in the death of her daughter, Caylee.

Anthony has already paid Baez and death penalty expert Andrea Lyon $111,954, but Baez said that is not enough to give Anthony the defense she needs, and taxpayers should make up the difference. Nearly $90,000 of the amount was used for Baez's fees, the remainder covered Lyon's costs. She is working on the case for free.

Baez said Anthony, 23, was willing to pay for her defense until the state put the death penalty back on the table, making her unable to cover the expense.

The motion asks the state to cover the cost of depositions, transcripts, investigators, legal research, expert witness fees, medical or mental examinations, travel expenses and other costs the defense has or will incur. <SNIP>

Defense team’s media spokesperson wrote in a release issued early Friday evening:

“The defense team is faced with extensive costs to defend Miss Anthony, ensure she receives a fair trial, and prevent the State from taking her life. The initial cost estimates for defending Miss Anthony have been far exceeded by the additional costs incurred since the State’s decision to pursue the death penalty. As a result, the defense is seeking state assistance to subsidize the costs of travel, serving subpoenas, hiring experts to interpret evidence and transcripts, deposing in- and out-of-state witnesses and investigating all aspects of the case,”

ORLANDO -- Casey Anthony will get her day in court beginning May 9, 2011.

Anthony pleaded not guilty and said a babysitter kidnapped her daughter, Caylee. The toddler's remains were found in December 2008, months after she was reported missing.

Prosecutors will release more evidence on Wednesday in the case against Anthony.

Her defense team wants pictures, interviews and phone calls thrown out.

Numerous pictures have surfaced showing Anthony partying with her friends.

The defense is arguing that these pictures create a huge bias against Anthony. The team also says only one set of pictures fall in the timeframe of when her daughter was missing.

Her lawyers say that any pictures taken at clubs, bars or parties before Caylee's disappearance are irrelevant.

In a new motion, the defense writes "the media has used multiple photos in order to vilify her as a ‘party girl’ who must be responsible for her daughter's death."

There's also a list of statements submitted by the defense that they want no mention of at Anthony's trial.

Some of those statements include the infamous 911 call when Cindy Anthony said "it smelled like a dead body in the car."

Or when George Anthony said to a tow truck worker "the daughter is telling us crap, a bunch of lies."

It also includes statements Roy Kronk made to former deputy Richard Cain.

Her team said it’s unfair to the case, and a jury should never hear about it.

The defense wants it all tossed out on the basis that its hearsay evidence.

Defense attorney Jose Baez said Anthony has given full financial disclosure. She also signed a form detailing how she has no money to mount a defense. Gardner made the indigency declaration based on the form.

"It's the most vague and superficial affidavit you can possible have," Attorney Richard Hornsby said.

Before Anthony qualifies for public funding, Hornsby said Strickland needs to probe much deeper than the one-page form.

"I've got to think that Judge Strickland is going to make Casey Anthony and Jose Baez make a full disclosure of how much he was paid, who brokered the deal, who managed the funds, where the funds have been sitting since Casey Anthony has been in jail," Hornsby said.

ORLANDO, Fla. --State administrators said Friday that they have serious concerns about Casey Anthony's request to be declared indigent.

The designation would allow Anthony to use public funds to cover some of the costs of her defense.

An attorney for the Justice Administrative Commission said the source of their concern with her application revolved around how much money Anthony has already paid for her attorneys.

The attorney pointed out Anthony has already come up with more than $110,000 to pay Jose Baez and Andrea Lyon, and it's not known where that money came from.

The JAC indicated they want to participate in next week's hearing as Judge Stan Strickland considers the issue. His decision could clear the way for Anthony to begin receiving tax dollars.

In their five-page response, the JAC also indicated they wouldn't pay for all costs, including travel expenses for out-of-state attorneys.

ORANGE COUNTY, Fla. -- A judge Friday afternoon granted Casey Anthony's request for indigence status. This means that taxpayers will front the cost for some of her defense on the first-degree murder charge she's facing.

JUDGE'S ORDER: Strickland Grants Indigence Status

“The Court has made a thorough review of all items submitted including the cost ledger of Defense Counsel and is satisfied that the Defendant has met all of the Statutory standards,” Judge Stan Strickland wrote in the order issued late Friday.

While this means things like paper work, experts and interviews could be paid by tax dollars, the cost of her lawyers is not covered. At this point, her defense team appears to be working free of charge.

J Cheney Mason Joins Casey Anthony Defense Team

Well known defense attorney J. Cheney Mason has joined Casey Anthony’s Defense Team. In an indigency hearing at 11:00am EDT in an Orlando, Florida courtroom. This is a complete surprise to the State prosecutors, and apparently the Judge also, who stated “What took you so long?” to Mr. Mason in court during Thursday’s indigency hearing for Casey Anthony… Casey Anthony’s disposition in court seemed upbeat, even though an inmate has been recently questioned repeatedly by the FDLE, as this unknown inmate has exchanged over 50 notes with Casey Anthony. What was said in these alleged notes has yet to be determined.
